OAKLAND — An identification card dropped at the scene led to the arrest and special circumstance murder charges being filed against a convicted felon in the robbery and fatal shooting of a man in the Fruitvale district Tuesday morning, according to authorities and court records.

Dawuan Budd, 25, of Oakland, was charged Thursday with murder in the commission of a robbery in the killing Godofredo Nah-Pool, 45, of Oakland. Police said the two did not know each other.

Besides the murder count, Budd is also charged with being a felon in possession of a firearm, carrying a loaded firearm in a city and unlawful firearm activity.

Police said Budd was out to rob someone when he saw Nah-Pool hanging out with another man about 12:10 a.m. Tuesday in the 2100 block of Fruitvale Avenue.

Budd robbed Nah-Pool of his backpack. When Nah-Pool struggled with him to get the backpack back Budd shot him, according to authorities. The confrontation was captured on video surveillance, according to court documents

In court documents, Sgt. Michael Cardoza said Budd dropped an identification card during the struggle which police found at the scene.

Cardoza said after the killing Budd ran with the backpack to a nearby residence. Information on the card led police later Tuesday to the home and Budd was arrested coming out of the house.

Authorities said the backpack and gun used in the killing were found in the house when police served a search warrant there.

According to court documents, Budd has four prior felony convictions that he was put on probation for. One was in 2009 for first-degree residential burglary. The other three were in February 2015 for possession of a firearm by a felon, carrying a concealed firearm in a vehicle and carrying a loaded firearm on one’s person in a city. He is being held without bail and is scheduled to enter a plea Friday.
